Purpose:

The Chartered Professional Accountants and Public Accountants Disciplinary Panel (the Disciplinary Panel) is the body from which an adjudication tribunal is chosen to hear complaints concerning practice that have been forwarded by the registrar.

Structure:

The board shall appoint at least 10 members of the association who are not members of the board, one of whom shall be appointed to serve as chairperson, and the minister shall appoint at least three persons who are not members of the association or persons currently or formerly certified, licensed or registered as accountants in the province or another jurisdiction to represent the public interest, who shall together constitute a disciplinary panel. At least one of the members of the association appointed by the board shall be licensed as a public accountant.

For the purpose of dealing with complaints referred to the disciplinary panel, the chairperson of the Disciplinary Panel shall appoint from it an adjudication tribunal consisting of three persons, of whom two shall be members of the association and one shall be a person appointed by the minister. The chairperson of the Disciplinary Panel shall appoint one of the members of the association on an adjudication tribunal to be the chairperson. Where a complaint that is referred to an adjudication tribunal involves an allegation against a respondent who is licensed as a public accountant, one of the members of the association appointed to the adjudication tribunal shall be licensed as a public accountant.

• Strategic management and organizational change;
• Legal expertise;
• Public relations;
• Public sector administration;
• Governance;
• Human resources;
• Experience with self-regulating organizations;
• Previous board experience;
• Analytical skills;
• Executive experience;
• Financial expertise or literacy; and,
• Decision making skills.

Qualifications:

The following are considerations in selecting members:

• High ethical standards and integrity;
• Appreciation of the responsibilities to the public;
• Flexible, responsive and willing to consider others’ opinions;
• Capable of a wide perspective on issues;
• Ability to listen and work as a team member;
• No direct or indirect conflict of interest; and
• Strong reasoning skills.

Time Commitments:

The Disciplinary Panel convenes to hear complaints concerning practice that have been forwarded by the registrar. There are no regularly scheduled meetings as the Disciplinary Panel is called upon as needed.

Term:

Members of the Disciplinary Panel shall be appointed for a term of three years. Notwithstanding the expiry of his or her term, a member of the Disciplinary Panel continues to be a member until he or she is re-appointed or his or her replacement is appointed. Persons appointed to the Disciplinary Panel may be re-appointed.

Vacancy Profile:

The Disciplinary Panel is seeking to fill three positions to represent public interest. Members of the Chartered Professional Accountants of Newfoundland and Labrador will not be considered for public interest positions. Expressions of interest are being sought from individuals who possess the background, experience and skill-set identified above, and who can bring unique persepctives to the table. Consideration will also be given to a variety of demographic factors to ensure the board is representative of the population they serve.
