Pursuant to section 24 of the Provincial Court Act, 1991, the Chair of the Panel will choose members to sit on adjudication panels to deal with complaints against Provincial Court Judges that have been referred by the complaints review committee.
The Lieutenant Governor in Council shall appoint a judicial complaints panel comprising 2 justices of the Trial Division of the Supreme Court of Newfoundland and Labrador nominated by the Chief Justice of the Trial Division; 2 persons who are judges of the provincial court of Nova Scotia, New Brunswick or Prince Edward Island, nominated by the chief judge of the person's court; and 2 persons, who are not Provincial Court judges, judges of another court, retired judges or members of the Law Society of Newfoundland and Labrador, to represent the public interest. Notwithstanding the expiry of his or her term of appointment, a member of the panel continues to be a member until he or she is reappointed or replaced.
The two public interest members appointed under paragraph 20(1)(c) of the Provincial Court Act, 1991 fall under the authority of the Independent Appointments Commission Act:
“2 persons, who are not Provincial Court judges, judges of another court, retired judges or members of the Law Society of Newfoundland and Labrador, to represent the public interest.”
The Panel meets as workload dictates.
Members of the panel shall be appointed for a term of 3 years and are eligible for re-appointment. Notwithstanding the expiry of his or her term of appointment, a member of the panel continues to be a member until he or she is reappointed or replaced.
