Disciplinary Panel of the College of Licensed Practical Nurses of Newfoundland and Labrador

Remuneration

Any remuneration or allowance is determined and paid by the College

Purpose:

This Panel will hear complaints regarding licensed practitioners.

Structure:

 The composition of the Disciplinary Panel shall reflect the cultural, ethnic, and regional diversity of the province.

The Panel shall consist of:

• at least 10 licensed practical nurses who are not members of the Board, appointed by the Board
• at least three persons, who are not licensed practical nurses, appointed by the Minister to represent the public interest, who shall together constitute a Disciplinary Panel
• the Board shall appoint one of the members of the Disciplinary Panel as a chairperson of the panel

For the purpose of dealing with complaints referred to the Disciplinary Panel, the chairperson of the Disciplinary Panel shall appoint from it an adjudication tribunal consisting of three persons, of whom two shall be licensed practical nurses and one shall be a member of the panel appointed to represent the public interest.

Competency Profile:

Diversity in the backgrounds, skills and experience of appointed Panel members can enhance the effectiveness of a Panel by bringing a wider range of perspectives and knowledge. Examples may include:

• Knowledge of the professional regulation
• Understanding the role of the Disciplinary Panel
• Familiarity with the principals of good governance, including accountability, transparency, and ethical conduct
• Effective communication skills, including the ability to listen actively
• Ability to read, analyze, and evaluate information related to the Disciplinary Panel
• Ability to work effectively and collaboratively with other members of the Disciplinary Panel
• Ability to make impartial, evidence based decisions in accordance with policy and procedures
• Willingness to maintain confidentiality and avoid conflict of interest
• Strong reasoning and conflict-resolution skills
• Backgrounds: health care, legal expertise, governance, labor relations
• Technological competence
• Leadership that fosters a diverse and respectful panel

Qualifications:

The following attributes are important considerations in selecting members:

• Previous board/disciplinary panel experience
• Expressed interest in health care
• High ethical standards and integrity
• Understanding and appreciation of confidentiality
• Experience with administrative decision-making, and decision writing
• Appreciation of responsibilities to the public
• Understanding of regulatory principles including fiduciary responsibilities
• Flexible, responsive and willing to consider others’ opinions
• Available and flexible with time
• Capable of a wide perspective on issues
• Listen and work as a team member
• No direct or indirect conflict of interest
• Effective communication skills (written and oral)

Time Commitments:

One public representative is required to participate in each hearing, as a member of the adjudication tribunal based upon availability. Those who participate in hearings often have to commit several sequential days and then, as needed, for further dates. Dates for meetings are set by consensus but must accommodate the full adjudication tribunal.

Term:

Of the members first appointed to the Disciplinary Panel, at least one half shall be appointed for a term of two years and the remainder for a term of three years and all subsequent appointments of members to the disciplinary panel shall be for a term of three years. Persons appointed to the Disciplinary Panel may be reappointed.

Notwithstanding the expiry of their term, a member of the Disciplinary Panel continues to be a member until they are reappointed or replaced.

Vacancy Profile:

The Disciplinary Panel of the College of Licensed Practical Nurses of Newfoundland and Labrador is seeking to fill at least three public interest representative positions. Expressions of interest are being sought from individuals who possess the background, experience and skill set identified in the board profile above and who can bring unique perspectives to the table. Consideration will also be given to a variety of demographic factors to ensure the board is representative of the population they serve.
