Composition:

The Lieutenant Governor in Council shall appoint no less than 5 and no more than 7 members; 1 representative of the Department of Advanced Education and Skills; 1 representative of the Department of Finance; 1 representative of the Newfoundland and Labrador Association of Career Colleges; an owner or operator of a private training institution; a student of a private training institution; and two community representatives. Under section 5.1 of the Private Training Institutions Act, a member of the board of directors appointed under this section whose term of office has expired shall continue to be a member of the board until he or she is reappointed or replaced and his or her decisions and actions as a director shall be considered to be valid.

Purpose:

The Private Training Corporation was created to ensure that students attending private training institutions are protected in the event of a school closure. To achieve this, the Corporation monitors the fiscal health of institutions and manages a Train Out Fund established in the Private Training Institutions Act.  The purpose of the Train Out Fund is to ensure that, in the unfortunate event a private training institution closes, appropriate financial resources are available to enable affected students to complete their course of study. 

Structure:

  • LGIC appoints no less than 5 and no more than 7 members (all subject to the Independent Commission).
    • One representative from the Department of Advanced Education and Skills
    • One representative from the Department of Finance
    • One representative from the Association of Career Colleges or its successor body
    • One owner or operator of a private training institution
    • One student of a private training institution
    • Two community representatives
  • A member of the board whose appointment has expired continues to be a member of the board until a successor is appointed.
  • Minister designates a chair and vice-chair.
  • A quorum is a majority of directors, one of whom must be the chair or vice-chair.

There have been different appointment processes for different positions on the PTC.  Notification of a vacancy has been sent to the appropriate group of individuals with a request for nominations.

  • Traditionally, the owner/operator position can be self-nominated whereas the Newfoundland and Labrador Association of Career Colleges (NLACC) representative should be nominated by the NLACC. 
  • Student reps have been nominated in different ways through the years – there have been instances where individuals have been nominated by the institution they are attending and other instances where nominations have been sought from Caucus.  This individual must be a current student at a private training institution.
  • The Departmental positions have been appointed by nature of their position – the departmental controller for AES is the departmental rep and the DM of Finance has traditionally held the Department of Finance position.  Both of these positions have the authority to send a delegate.

Time Commitments:

Members of the Private Training Corporation should be available to meet 2-3 times per year. Where there is the potential for a train out of a private training institution, more meetings may be required. Board members may also be expected to spend additional time to review materials and prepare for Board meetings. The Board may create sub-committees and the number of meetings would be at the discretion of the Chair.  Meetings are usually held during normal business hours at Confederation Building.

Term:

Pursuant to Section 4(5) of the Private Training Institutions Act, directors shall not hold office for more than 3 consecutive years and are eligible for reappointment.

Additional Information:

The Private Training Corporation board members are not compensated for the time spent attending board meetings but will be remunerated for costs associated with travel to attend meetings. These costs are paid from the Train Out Fund.
